With the onset of another crisis in the economy, the state had to provide support to mortgage borrowers who found themselves in a difficult financial situation. In April 2015, the corresponding Decree 373 of the Government of the Russian Federation dated April 20, 2015, signed by D.A. Medvedev. Initially, this resolution provided for the validity of the assistance program until the end of 2016, but it has been repeatedly amended and supplemented. To date, according to latest changes 373 Decrees of the Government of November 24, 2016, assistance to mortgage borrowers (mortgage restructuring) is valid until March 1, 2017(extended until May 31, 2017 Decree of the Government of the Russian Federation of February 10, 2017 No. 172, since March 7, 2017, the acceptance of new applications has been suspended due to the expenditure of funds under the program.

However, in July 2017, an additional 2 billion rubles were allocated from the government fund to restart the program. On August 11, 2017, new conditions for participation in the mortgage borrower assistance program came out - which you will learn about from this post) and is as follows:

  • The borrower's mortgage obligations to the bank are reduced in the amount of 20% to 30% of the balance (at the discretion of the lender's bank), but not more than 1,500,000 rubles.
  • By agreement between the borrower and the bank, you can choose the format of assistance, namely, either send the entire amount of assistance to the mortgage to pay off the principal and thereby reduce the monthly payment, or to reduce the monthly payment by 50% or more for up to 1.5 years.
  • Replacing a foreign currency mortgage with a ruble one. At the same time, the mortgage rate cannot be higher than 11.5% per annum. For a ruble mortgage, not higher than the bank's current rate, except in cases stipulated by the mortgage agreement, in case of violation of insurance rules.
  • Until September 1, a special interdepartmental commission should be created, which will be able to increase the maximum payment under the program by 2 times and approve applications for participation if there are deviations from the basic conditions, but not more than in two points.

Changes in the assistance program for mortgage borrowers dated February 10, 2017 suggest that the maximum reimbursement of 30% of the balance (up to 1.5 million rubles) is compensated by the state only if the family has two children or you are disabled (child disabled), and combat veterans may also apply. With one child you can only claim 20%. August 10, 2017 changes allow for larger maximum payout twice by decision of a special interdepartmental commission. Also mortgage must be issued no earlier than 12 months before the date of filing the application for restructuring.

Having analyzed negative feedback on the payment of a mortgage with the help of the state, our experts came to the conclusion that most often the reason for refusal is false information provided by the borrower and lack of knowledge of the basic requirements and conditions for state support. Who can receive support from the state

Government Decree No. 373, as amended on November 24, 2016, provides for the following list of persons to whom the state can help pay mortgage payments:

  • Citizens of the Russian Federation with 1 or more minor children;
  • Guardians (custodians) of 1 or more minor children;
  • Participants in hostilities;
  • Disabled people or families with disabled children;
  • Citizens with dependent children under 24 who study full-time at an educational institution.

Mortgage requirements

To receive assistance from the state, a mortgaged apartment must meet these characteristics:

  • It should not exceed the total area for a one-bed apartment - 45 sq.m., for an apartment with two rooms - 65 sq.m. and for three rubles and more - 85 sq.m.
  • The cost of 1 sq.m. total housing area exceeds no more than 60% average cost a typical apartment in your region as of the date of conclusion of the loan agreement (according to Federal Service state statistics).
  • The dwelling must be the only one for the mortgage borrower. At the same time, it is allowed to have a total share of ownership of all family members of no more than 50% in one other residential building. Important point! The requirement for the total area of ​​mortgage housing and the cost per square meter does not apply to families with 3 or more minor children. How to get government support

First of all, you need to contact the bank where you received the mortgage. Almost all major banks participate in this program of assistance to mortgage borrowers. The full list can be downloaded.

As a rule, this issue is dealt with by the department for dealing with overdue debts. It is enough just to call the contact center of your bank and find out where it is located.

The bank will give you a list of documents for state support by mortgage. An example list is provided below:

The list is quite impressive and will make you run a little, but it's worth it. The only moment that is rather complicated is extracts from the USRN. They cost money. One statement on the rights to property throughout Russia is 1,500 rubles per person and no one will return them to you if you refuse. There were a lot of complaints about this last time. From 08/11/2017, the requirement for an extract from the USRN has been cancelled. The bank has no right to demand it. AHML independently requests it.

After full list documents submitted to the bank, the responsible officer must send them to AHML for verification. On average, it lasts 30 days, but the feedback from the participants indicates that it can reach up to six months. the bank and AHML request additional documents at their discretion.

When AHML makes a positive decision, the bank will notify you of the date of the meeting. Next, you will need to sign a new payment schedule, new document PSK, conclude an agreement on restructuring (an additional agreement to the mortgage agreement), an agreement on changes in the terms of the mortgage. Next, you will need to wait from 2 to 4 weeks, when the mortgage will be requested from the bank's archive. After that, it is necessary together with the complete package loan documents and an agreement on changes in the terms of the mortgage (be sure to make copies) to visit justice for state registration of changes.

The process is similar in Gazprombank. VTB 24 closes the mortgage and issues a new loan for a smaller amount, which means that you again have to pay insurance and assessment costs.

There is no mortgage restructuring fee. Carrying out this procedure does not exempt you from paying the monthly payment and insurance premiums stipulated by the contract.

This project is implemented through the Agency for Housing Mortgage Lending (AHML). Options for helping mortgage borrowers

It is important to note right away that at the moment the program applies exclusively to contracts concluded under it during the period until May 31, 2017. We also advise you to first clarify with your bank his participation in the program and the availability of funds allocated by the budget for this assistance, since in their absence, all actions to collect documents and process them will be in vain.


It should be understood that this program provides for several options for financial assistance, of which in the future the borrower himself with his bank chooses the most suitable one. Moreover, the procedure itself provides for the restructuring of a debt obligation through additional agreements or the conclusion of a new loan agreement. Direct assistance can be provided in one of four ways.

  1. Repayment of part of the principal debt on a mortgage. This option provides for a one-time transfer of funds, the amount of which cannot exceed 20% of the balance of the debt at the time of restructuring and 600,000 rubles (30% and 1,500,000 rubles for large families, and those who have two minor children), with the intended purpose - reduction in the amount of principal debt.
  2. Decreased monthly payment. Its size will be reduced by at least 50% for up to 18 months.
  3. decline interest rate . If the mortgage was originally issued in rubles, then the level of the newly established commission for the use borrowed money should not exceed its current value, and for loans in foreign currency- no more than 12% per annum.
  4. Change in lending currency. As assistance, it is envisaged to restructure debt from foreign currency into rubles at the exchange rate set by the Central Bank of the Russian Federation at the time of the transaction.

It is worth noting that deferred payment is also available. That is, provided Grace period on the repayment of a mortgage, which provides for the period of its validity, the release of the borrower from the obligation to pay part of the principal debt and accrued interest.

Conditions for obtaining assistance to mortgage borrowers from AHML

To use the program, a mortgage borrower, in addition to being a citizen of the Russian Federation, must meet all four basic requirements. If at least one of the conditions is not met, then, unfortunately, assistance will be denied.

1. Relation to a social group. It will be enough to meet one of the following conditions:

  • Has one or more minor children (own, adopted or officially in care);
  • Combat veteran;
  • Himself is disabled or there is a disabled child in the family;
  • A dependent who is a student under the age of 24 is on provision.

2. Lack of family income. If earlier (before 2017) a mandatory reduction was required wages the borrower has at least 30%, then at the moment this condition is canceled. To meet this requirement, it is enough that the average family income for the last three months, after paying off the mortgage loan, does not exceed two living wages corresponding to the borrower's region of residence, for each member of his family.


For example, a person living in the Saratov region received 150,000 rubles over the last 3 months. In this way average salary will be 50,000 rubles. His family consists of three people - himself (the borrower), his wife (co-borrower) and a minor child. wife gets maternity payments, the amount of which for the last 3 months amounted to 30,750 rubles. That is, the average value is 10,250 rubles. Planned expenses, according to the schedule, to pay the mortgage monthly amount to 15,430 rubles.

The calculation is made as follows. From the total family income, which in this case will be 60,250 rubles per month, the costs of paying off the mortgage are deducted. The net balance will be 44,820 rubles. This amount will need to be divided by all family members, that is, by 3. Accordingly, each account for 14,940 rubles.

Now it remains to compare the amount of income with twice the subsistence minimum, which in the corresponding region is 8,773 rubles for the able-bodied population, and 8,300 rubles for children. Each capable family member (borrower and co-borrower) must have an income of up to 17,546 rubles, and for a child - up to 16,600 rubles. All values ​​exceed the actual average income received by each family member. Thus, according to the example, the borrower meets the second requirement of the program.


3. Compliance with living space. In addition to the mandatory use of an apartment, which in addition is located on the territory of the Russian Federation, as collateral for a mortgage loan, it is necessary that it:

  • According to the estimated cost, in the calculation of the price per 1 sq. meter, does not exceed 60% of the cost of 1 sq. meters of the relevant real estate according to the Federal State Statistics Service at the time of execution of the loan agreement;
  • The total living space did not exceed 45 sq. meters, if 1 room is indicated in its layout;
  • The total living space did not exceed 65 sq. meters, if its layout indicates 2 rooms;
  • The total living space did not exceed 85 sq. meters, if its layout indicates 3 rooms or more.

It should be borne in mind that all requirements for footage and cost do not apply to citizens who have three or more minor children in the family. Accordingly, it is enough that the housing is located on the territory of the Russian Federation and is collateral for a mortgage loan.


4. Single housing. The real estate specified in the third paragraph must be the only habitable premises owned by the pledgor. Although it is allowed to have available to the borrower himself and his family members in the ownership of up to 50% of one other residential property.

Required package of documents

In case of compliance with all four of the above requirements, it is necessary to proceed to the collection of a package of documents. It should be noted right away that the legislative framework allows the bank to supplement the list of required documents on an individual basis. New rules for the state program to help mortgage borrowers in difficult financial situations came into force in Russia on Tuesday, August 22.

The assistance program for mortgage borrowers was launched in April 2015: banks restructured problem mortgages at a rate of no more than 12% per annum, and the state compensated part of the monthly loan payment.

The program expired on May 31, 2017, while the 4.5 billion rubles allocated for it were already spent as of March.

At the end of July, Russian Prime Minister Dmitry Medvedev signed a decree on the allocation of another 2 billion rubles from the government's reserve fund to the program as a contribution to the authorized capital of the Agency for Housing Mortgage Lending (AHML), and on August 11, a decree specifying the conditions for implementing the program. According to the government, the allocated funds will allow restructuring at least 1.3 thousand mortgage loans.

The main innovation of the updated state assistance program is that only holders of foreign currency loans can use the program. The government and banks explain this very simply: the first wave of the program was aimed at supporting holders of ruble loans, now it's the turn of foreign currency loans.

AHML again acts as the operator of the program to help borrowers this year.

The new state aid program is funded from Reserve Fund Russian government in the amount of 2 billion rubles. It should be noted that its extension will allow restructuring at least 1.3 thousand mortgage loans. The program operator is traditionally the Agency for Housing Mortgage Lending (AHML).

In March 2017, the Minister of Finance of the Russian Federation Anton Siluanov, following a meeting with foreign-currency mortgage lenders, proposed setting up the system of state assistance to mortgage borrowers in such a way as to shift the focus to foreign-currency mortgage lenders.

At meetings with the Ministry of Finance and AHML, activists of the currency mortgage movement insisted on a "product approach", when the key criterion for joining the program is the very fact that a citizen has obligations under a targeted housing mortgage loan (loan), calculated in foreign currency and accepted in the period up to the end 2014.

As a result, in accordance with a government decree, it was decided that, within the framework of the updated program, banks would restructure problematic foreign currency mortgages at a ruble rate for a client not exceeding 11.5% or ruble problematic mortgages at a rate not higher than the rate in force on the date of the loan restructuring.

Borrowers who have passed at least 12 months from the date of obtaining a mortgage loan to the date of filing an application for restructuring, and whose monthly loan payment has increased by at least 30%, will be able to take part in the program.

The mortgaged housing must be the only housing of the mortgagor's family. At the same time, the total share of his family members in the ownership of no more than one other residential premises is allowed in the amount of no more than 50% from April 30, 2015.

For example, Sberbank clients can receive state support. For borrowers who have taken out a mortgage loan secured by their own housing, special conditions apply:

  • Any housing can be pledged, including those to which the right to claim equity participation in construction under a contract is extended;
  • This property must be the only place of residence of the borrower. It should be noted that the total share in the property of each owner must be less than 50%;
  • The area of ​​a one-room apartment, which is pledged, should not be more than 45 square meters. For two-room apartment the maximum limit is 65 square meters, and for a three-room apartment and more - up to 85 square meters;
  • The value of the mortgaged real estate should not exceed the cost of standard housing in the primary and secondary market by more than 60%.

  • "stretching" the term of the mortgage, due to which the size of the monthly payment is reduced;
  • deferred payment of the principal debt for up to 6 months (i.e. the borrower pays only interest for these six months);
  • postponement of the payment date;
  • lowering the interest rate to a minimum of 9.23% (if the key rate is lowered by the Central Bank, an even more intensive rate cut is not ruled out);
  • conversion of foreign currency mortgages into rubles at a fixed preferential rate.

Note that the first type of restructuring is always used by the bank, the rest - at will.

The purpose of the borrower is to show that he found himself in a difficult financial situation, but at the same time he does not refuse his obligations and is ready to fulfill them if the bank provides him with more loyal conditions.

  • citizens who are disabled or have disabled children;
  • citizens who are combat veterans;
  • citizens who are dependent on persons under the age of 24 who are students, students (cadets), graduate students, adjuncts, residents, assistant trainees, interns and full-time students.
